These terms govern the use of Marchildon's website and the services offered on it. By accessing the site or using our services, you agree to be bound by these terms. If you do not agree, please do not use the site.
1. Services
Marchildon offers custom foot orthotics, orthopedic footwear, compression garments, and biomechanical analysis services. All our services are provided by orthotist-prosthetists who are members of the Ordre des technologues professionnels du Québec (OTPQ) and the Association des orthésistes et prothésistes du Québec (AOPQ).
2. Medical prescription
The fabrication of foot orthotics and certain orthopedic devices requires a valid medical prescription. It is the patient's responsibility to provide this prescription before the device is delivered.
3. Payment and reimbursement
Payment is due at the time of delivery of the product or service, except for government agencies (RAMQ, CNESST, SAAQ, Veterans Affairs Canada, Indigenous Services Canada) for which we bill directly. Private insurance claims are the patient's responsibility; we provide the detailed receipts required.
4. Warranty
Our orthotics are covered by a warranty against manufacturing defects. Adjustments during the adaptation period are included. See our warranty page for full details.
5. Appointment cancellation
We require 24 hours' notice for any cancellation or change of appointment. Late or repeated cancellations may incur fees.
6. Intellectual property
All site content — including but not limited to text, photographs, illustrations, logos, videos, trademarks, and downloadable files — is the property of Marchildon or its licensors, and is protected by Canadian and international copyright and intellectual property laws. Any reproduction, distribution, modification, or use without prior written authorization is strictly prohibited.
7. Use of the site
You agree to use the site only for legitimate purposes and in accordance with these terms. It is prohibited to access the site by unauthorized means, introduce viruses or malicious programs, or attempt to compromise its integrity or security.
8. Limitation of liability
The site and its content are provided "as is", without warranty of any kind. The information published is for informational purposes only and does not replace professional consultation. To the extent permitted by law, Marchildon cannot be held liable for direct, indirect, incidental, or consequential damages arising from the use of or inability to use the site or its content.
9. Indemnification
You agree to indemnify and hold Marchildon harmless from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the site or breach of these terms.
10. Links to third-party sites
Our site may contain links to third-party sites provided for informational purposes. Marchildon is not responsible for the content, practices, or policies of these sites and does not necessarily endorse their content.
11. Applicable law and jurisdiction
These terms are governed by the laws in force in the province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these terms is subject to the exclusive jurisdiction of the courts of the judicial district of Quebec.
12. Severability
If a provision of these terms is found to be invalid, illegal, or unenforceable by a competent court, that provision shall be removed without affecting the validity or enforceability of the other provisions.
13. Changes to these terms
Marchildon reserves the right to modify these terms and conditions at any time to reflect changes in its practices or legal requirements. Changes take effect upon publication on the site. It is your responsibility to consult this page periodically.
